Admitted thief loses unfair dismissal case

0

NASSAU- A cashier who was fired after repaying stolen funds has lost a claim for unfair dismissal.

Angela Rahming pocketed $500 out of the $1,500 that she collected for inpatient drug treatment at Sandilands Rehabilitation Centre (SRC) on November 30, 2017.

Rahming, who worked at the Community Counselling and Assessment Centre (CCAC), created two receipts. She gave one for $1,500 to the customer, but submitted a second dated December 1, 2017 that showed she collected $1,053.

The theft was uncovered when the customer returned the CCAC on January 15, 2018 with her receipt and requested a refund because her relative “ran out of the hospital and was never admitted to Sandilands for the treatment.”

The Finance and Accounting Officer Theresa Ford called Rahming and asked why the sum deposited did not correspond with the amount paid.

Rahming in a subsequent call admitted that she had used $500 for a personal matter.

She alleges that she was promised that if she paid the money back “no one would know” about the theft.

During an investigation into the matter, Rahming was transferred to SRC.

When it was discovered that she was still handling cash, Rahming was assigned to paperwork duties in the SRC business office .

Rahming repaid the missing funds on February 1, 2018.

The inquiry into her actions continued. After being given an opportunity to respond, she was fired on July 16, 2018.

Rahming received $12,325.04 in lieu of notice and in severance pay.

She also received $ 9,469.62 for accrued vacation pay.

After she unsuccessfully challenged the Disciplinary Committee’s decision before an appeal committee, Rahming filed a trade dispute against the Public Hospitals Authority.

She sought reinstatement or damages.

Rahming’s lawyer argued that she was punished twice because she repaid the money before her dismissal.

But Industrial Tribunal found there was no reason to rule in her favour.

She has to repay the stolen money before she completes her six-month sentence. Otherwise, she will spend an additional 18 months behind bars.

Serial groper loses bid to cut sentence

0

NASSAU- Serial groper Sidney Cooper has lost his bid to reduce his six-year sentence for feeling up a teen in downtown Nassau.

Cooper, 45, grabbed the 18-year-old’s butt as she tucked her blouse into her skirt on June 12, 2019.

Cooper’s history of indecent assaults against women dates back to 2000, and he reoffends, almost immediately, after release.

He attacked the teenager days after his release from prison for groping a nine-year-old girl in 2016 and a policewoman. Cooper indecently assaulted the officer while on trial for groping the minor.

Despite this, Cooper argued that magistrate was wrong to double the maximum three-year sentence.

The Court of Appeal disagreed and dismissed Cooper’s appeal last month.

The Justices of Appeal said, “We are satisfied that the magistrate was correct to impose the additional three years having regard to the fact that it is clear that the appellant is a habitual offender.”

Cooper, 43, has been diagnosed with frotteurism—
the practice of achieving sexual stimulation or orgasm by touching and rubbing against a person without the person’s consent and usually in a public place.

The Court of Appeal ordered authorities “to make every effort to ensure that the appellant receives counselling, so that when he is released from prison that this does not happen again.”

Turnquest, a solar panel technician, on Monday pleaded not guilty to the charges at his arraignment before Deputy Chief Magistrate Andrew Forbes.

Turnquest is free on $7,000 bail. His trial is set for June 23.

Accused killer loses bail appeal

0

NASSAU- A man accused of murder and attempted murder has lost his appeal against a judge’s decision to refuse him bail.

Lorenzo Wilson, 24, will now remain in custody at the Bahamas Department of Corrections until trial.

Prosecutors say that Wilson fatally shot Deano Gordon and opened fire on Superintendent Warren Johnson on April 7, 2020 at Hampton Street.

Gordon was at a yard where he did auto body work when a man armed with an assault rifle fatally shot him.

Superintendent Johnson, who was in the area, heard the gunshots and went to investigate. He allegedly recognized the gunman, who shot at him.

Johnson was not injured and returned fire on the gunman.

Wilson made his first court appearance in June 24, 2020.

Justice Deborah Frazier denied him bail on October 29, 2020.

Justices Sir Michael Barnett, Roy Jones and Carolita Bethell upheld the decision.

They said, “In our view, it was not unreasonable for the judge to have found that the appellant was a danger and not a fit person to be granted bail.

“It is unfortunate that the judge did not set out her reasons why she did not think any conditions could be imposed to ameliorate her concerns. This should have been done.

“We cannot say that the decision to deny bail was an unreasonable exercise of her discretion. We did not find any factor that the judge did not take into account; nor was there any fact that she took into account that she ought not have taken into account.”
