Man arrested over $4 meal

NASSAU-A man who tried to steal a $4 meal could go to prison for three months if he breaks his probation.

Presley McKee, 39, of Cowpen Road, got a small plate of macaroni with some meatballs from the deli at Super Value Food Store in Golden Gates on November 3.

But he started to eat the food before he paid for it, resulting in his arrest.

McKee pleaded guilty to attempted stealing at his arraignment before Magistrate Kendra Kelly.

He admitted that he opened his plate and started eating his food before he reached the cashier.

But he complained that store’s staff didn’t give him a chance to pay the $4.45 for the food.

He claimed that they took him into a back room and beat him.

McKee was sentenced to probation for six months.

If he gets into any more legal trouble during the probationary period, he’ll be sent to prison for three months.

 

Man accused of sexual misconduct with girl, 14

NASSAU- A man accused of sexual misconduct with a 14-year-old girl has been granted bail.

Matthew Butterfield, 39, of Village Crescent, allegedly touched the child’s vagina before he told her, “That’s what I want.”

The incident allegedly occurred on August 4, 2021.

Butterfield, who is otherwise known as Butters, is a friend of the alleged victim’s uncle.

Butterfield pleaded not guilty to a charge of indecent assault when he appeared before Magistrate Samual McKinney.

He was granted $3,500 bail and returns to court in February for trial.

Inspector Timothy Bain prosecuted.

 

Pair charged in robbery of Exuma tourist

NASSAU- Police have arrested two men who they say are responsible for the armed robbery of a tourist in Exuma last week.

Robert Symonette, 21, and Jamal Bullard, 18, were arrested on armed robbery and firearm charges.

The robbery happened on November 29 at Gregory Town, Exuma.

The tourist, Nathan Johnson, was walking from the Fish Fry to his hotel when he was accosted by two men, who robbed him at gunpoint.

The robbers took Johnson’s wallet, valued at $300 and his slippers, worth $80.

Police allegedly found the men in possession of a 9mm pistol with eight rounds of ammunition on December 1.

They were not required to enter pleas to the armed robbery and gun charge when they appeared before Magistrate Samuel McKinney on Monday, December 6.

They were denied bail and will return to court on February 1.

Teen accused of murder of man in car

NASSAU- A teen accused of the murder of a man found shot to death in a car has been denied bail.

Brandon Adderley, 18, is accused of the November 29 shooting death of Diano Nixon, otherwise known as “Shadow.”

Police responded to reports of gunshots at Hospital Lane around 8pm.

When they arrived, they met a Nissan March with its engine running.

Police found Nixon slumped over the wheel with multiple gunshot wounds to the body.

Prosecutors allege that Adderley is responsible for Nixon’s murder.

He did not have to enter a plea to the charge when he made his initial court appearance before Magistrate Samuel McKinney on December 6.

He was denied bail. His next court date is January 13.

On that date, prosecutors expect to fast track Nixon’s case to the Supreme Court by presenting a voluntary bill of indictment.

Adderley did not have a lawyer. Inspector Timothy Bain prosecuted.

Indecent exposure case dropped against mentally ill man

NASSAU- Prosecutors have dropped an indecent exposure case against a mentally ill man who spent eight months in prison on remand.

Police arrested Joel Griffin, 29, on March 24 after he exposed his penis to a schoolgirl.

The incident happened around 9am at Madeira Street in Palmdale.

The sixth grade student of Palmdale Primary School was walking to school when Griffin followed her and exposed himself.

Motorists who saw Griffin’s disturbing actions chased him and called police.

Officers arrested Griffin a short time later.

During an interview later that day, he told investigators that he was attracted to the size of the child’s butt. Griffin said because his “hip was already showing he thought it would be sexy for his penis to show as well.”

He pleaded guilty to the indecent exposure charge at his arraignment on March 25.

He accepted a summary of the evidence that the prosecutor would have presented had the case gone to trial on April 1.

However, Magistrate Ferguson-Pratt ordered the mental evaluation after Griffin said that he had been to Sandilands Rehabilitation Centre (SRC) before.

Due to a halt on new admissions at SRC, the Magistrate had to send Griffin to prison. Staff from SRC visited him at the prison to carry out the mental tests.

Subsequent reports from SRC made Griffin’s guilty plea invalid, as doctors determined he was unfit to plead to the charge.

On December 6, the prosecutor withdrew the charge since Griffin’s time on remand exceeded the maximum penalty for the offense.

As a result, he was released from custody. Since the matter was withdrawn, the incident will not appear on Griffin’s criminal record.

At a court appearance last week, Griffin claimed he had already completed his medication. He said he wanted to be released in time for Christmas and he looked forward to eating fruitcake over the holiday.

 

 

 

 

Bella’s mom loses court fight over burial

NASSAU- Murdered toddler D’onya Bella Walker’s mother has lost a court battle against the child’s father over where she should be buried.

Justice Loren Klein on Monday, December 6 dismissed an application by Ostonya Walker in which she sought full control of the four-year-old’s final resting place.

This means that Bella’s father, Deno Smith, will determine how and where she is buried.

Still, Justice Klein said he hoped the arrangements included Ostonya’s family. He said they were “also entitled to say their goodbyes in a respectful and dignified manner.”

Prosecutors have charged Ostonya’s live-in boyfriend, Darion Smith, with the child’s November 5 beating murder. She, too, is accused of contributing to her daughter’s untimely death and is charged with exposing the child to grievous harm and child cruelty.

However, the pending criminal charges did not play a role in Justice Klein’s decision to rule in favour of the father.

He said, “The court pauses here to make a significant observation: Ostonya is not on trial here, and neither is this a character contest between her and Deno. She is entitled to the constitutional presumption of innocence.”

Baby Bella was born out of wedlock on June 2, 2017 at the Rand Memorial Hospital in Freeport, Grand Bahama. Ostonya and Deno lived together from 2016 until a few months before Bella’s birth.

Although Deno is not registered on Bella’s birth certificate, Justice Klein said his paternity has never been in dispute.

Closest ties

Her father and his family had “Baby Bella from two weeks after her birth, while her mother pursued various job opportunities in Grand Bahama, Marsh Harbour Abaco and New Providence.”

Justice Klein said, “It seems she was content to leave the child in the care of her father and paternal relatives, although her evidence is that she did on a few occasions assume custody and care of Baby Bella.

“In what turned out to be a cruel twist of fate, she was returned to her mother in New Providence on 31 August 2021, apparently at the mother’s request. Two months and 5 days later she was dead.”

Justice Klein said, “The evidence is overwhelming as to where Baby Bella had the closest connections during her life, both temporally, geographically, and in terms of relationships.

“Although there are some minor disputes (and on this point I prefer the defendant’s evidence), it would appear that Baby Bella spent roughly two months and three weeks out of the four years of her tragically short life in Nassau.”

He said it was “a startling and somewhat sobering realization that the paternal caretakers have spent significantly more time with Baby Bella than her mother.”

Policewoman wounded in shooting

NASSAU- A policewoman was seriously injured in a shooting Sunday night.

The reserve corporal was among two women shot by the occupants of a small gray car at Peter Street around 9:30pm on December 5.

Both women reportedly live in the area.

The officer at the Nassau Street Police received gunshot wounds to the stomach. The other woman was shot in the thigh.

Police said that they are both in stable condition.

Meanwhile, police are investigating another shooting on Sunday.

Police said that around 9pm a man was shot in the face by an unknown gunman at Polhemus Street.

The gunman fled on foot and his victim is in serious condition at hospital.

 

Court rejects serial groper’s bid for second appeal

NASSAU- The Court of Appeal has refused to allow serial groper Sidney Cooper another chance to challenge his six-year sentence for indecent assault.

Cooper on December 3 asked appellate court judges to use a rarely used discretion to reopen his appeal. The panel dismissed his appeal on February 16.

Cooper begged the Court to have mercy on him during the Christmas season because “six years is too much for a minor offence.”

But Justice of Appeal Stella Crane-Scott told Cooper that indecent assault was not a minor offence. She reminded him that he had a lengthy rap sheet for the same crime.

Cooper’s history of indecent assaults against women dates back to 2000. He reoffends, almost immediately, after release.

Cooper got his longest sentence for the indecent assault of an 18-year-old girl in downtown Nassau on June 16, 2019.

He committed that assault days after his release from prison for sexually touching a nine-year-old girl in 2016 and a policewoman. Cooper felt up the officer while on trial for groping the minor.

In February, Cooper argued that the magistrate exceeded his sentencing power as indecent assault attracts a maximum penalty of three years in prison.

However, the law allows for the penalty to be doubled for habitual offenders. The Justices of Appeal said, “We are satisfied that the magistrate was correct to impose the additional three years having regard to the fact that it is clear that the appellant is a habitual offender.”

However, with time off for good behaviour Cooper could serve only four years of that sentence before he’s released.

Cooper became upset when the appeal panel told him that he had to serve his sentence. He said, “This doesn’t make any sense; y’all joking.”

He continued his rant until the court’s clerk shut off his microphone and called another case.

Cooper has frotteurism. This means he’s turned on by touching and rubbing against strangers in public.

The Court of Appeal ordered authorities to ensure Cooper gets treatment, “so that when he is released from prison that this does not happen again.”

 

 

One dead after tug boat sinks off Abaco

ABACO-A tug boat sank off Sandy Point, Abaco on Sunday, and one crew member died and three were rescued.

The 65-foot vessel was headed to Cooper’s Town, Abaco from New Providence.

It experienced mechanical problems in the area of Hole in the Wall around 4am on December 5.

The captain made a distress call and the four crew members abandoned the boat as it went down.

The U.S. Coast Guard and BASRA assisted in the rescue and recovery.

The cause of the sinking is under investigation.

Schoolgirl flasher spends 8 months in jail without sentence

NASSAU- Schoolgirl flasher Joel Griffin has spent eight months in prison without being sentenced.

Griffin admitted to following the 10-year-old Palmdale Primary student and exposing himself when he appeared in court on March 25, the day after his arrest.

The Court heard that Griffin followed the young girl and flashed himself because he was attracted to the size of her butt.

Alert motorists prevented Griffin from taking his attraction to the child any further when they sprang into action and chased him off.

Police arrested him a short time later.

Chief Magistrate Joyann Ferguson-Pratt ordered a psychiatric report “out of an abundance of caution” after he said he’d previously been admitted to Sandilands Rehabilitation Centre (SRC).

Due to a halt on new admissions at SRC, the Court had no choice but to send him to prison and direct that the evaluation take place there.

Subsequent mental health reports have found that Griffin is not fit to plead.

During a court appearance last week, Griffin appeared eager to spend Christmas at home.

He said he looked forward to eating fruitcake.
