Man charged in 2 separate murders

Nassau, BAHAMAS- A man is being held without bail after he was charged with two separate murders.

Leonard O’Brien appeared before Acting Chief Magistrate Roberto Reckley on Friday.

Police say O’Brien shot at killed Dario McPhee on April 10 as he cleaned fish on a boat that was moored at the back of the Sand Trap on West Bay Street.

Then, on May 26, authorities say O’Brien shot at killed Bryan Smith at Hospital Lane.

The motive in either case is unknown.

O’Brien is back in court on October 5 to receive a voluntary bill of indictment.

Court affirms 8 month sentence for $220 of weed

The Court of Appeal has affirmed an eight-month sentence for a man who had $220 worth of marijuana with intent to supply.

Tracy Morley was arrested after 3.78 ounces of marijuana, contained in two plastic bags, and a scale were found in his baggage while at the airport.

In a subsequent interview with police, Morley said he had bought the drugs for $220 to smoke.

He pleaded guilty to drug possession with intent to supply at his arraignment before Magistrate Carolyn Vogt-Evans on June 15 and was sentenced to eight months’ imprisonment.

In passing sentence, the magistrate took into account a 2017 conviction for the same offense. On that occasion, Morley was given the chance to avoid spending 15 months in prison, provided he paid a $3,500 fine.

Morley, who was unrepresented at his arraignment, hired Dion Smith to appeal the sentence on the basis that it was unduly harsh. Morley will not receive time off for good behaviour because of the charge.

At the appeal, Smith noted other instances where repeat offenders had been fined by other magistrates.

Justices of Appeal Jon Isaacs and Sir Brian Moree affirmed the sentence.

In a dissenting decision, Court President Sir Michael Barnett said he would have allowed the appeal and sentenced Morley to the six weeks he had already served along with a fine of $3,000, which would result in an additional three months in prison if not paid.

Sir Michael said notwithstanding Morley having a scale, there was no evidence before the court that he intended to sell the marijuana.

Sir Michael said, “In my judgment, sentences should move away from imprisonment for small amounts of marijuana for persons who use it to smoke. That is the purpose for which the appellant said that he bought the marijuana.”

On the other hand, Justices of Appeal Isaacs and Moree frowned on the practice other magistrates to fine persons with multiple convictions for drug possession with intent to supply.

Justice Isaacs noted that it was the number of packets that triggered the presumption of intent to supply and not the weight of the drugs.

He added, “While a person with hundreds of pounds of marijuana may well be considered a wholesaler of the drugs, this does not discount the value of a person with mere ounces of drugs as being a retailer or petty drug dealer; the latter’s role is equally important in the supply of drugs to the end-user.”

Sir Brian disagreed with the trend of not jailing people convicted of having small amounts of drugs with intent to supply.

He said, “ It seems to me that it does not serve the peace and order of society for the courts to minimize the serious offense of dealing in or supplying illegal drugs to others.

“ I apprehend that equivocation by the courts on this subject may be misinterpreted by persons in society and lead to the increase in the occurrence of that offense.”

Wanted man hurt in shooting that killed friend

Nassau, BAHAMAS- A man wanted by police for attempted murder was injured in a shooting that killed his friend.

Wanted suspect Romeo Cooper, otherwise known as Lil Roe, was at Hay and Market Streets when he was shot by a lone gunman on July 20. The same man fatally shot Frantwion “Lefty” Newton in the same incident.

The victims were both hanging out when they were ambushed by the shooter.

Police have charged 25-year-old Davanno Miller with murder and attempted murder. He’s also charged with possession of a firearm with the intent to endanger Cooper’s life.

Acting Chief Magistrate Roberto Reckley remanded Miller to prison at his initial court appearance.

Miller is next due in court on October 31.

Man accused of rape of tourist in Exuma

Nassau, BAHAMAS- A 35-year-old man has been charged with the rape of an American tourist during a burglary in Exuma.

Bradley Rolle, of Rolle Town, Exuma appeared before Acting Chief Magistrate Roberto Reckley charged with burglary and rape.

Prosecutors say Rolle broke into a rental home and raped a 67-year-old woman from Florida.

Rolle was not required to plead to the charges and was denied bail.

He is next due in court on October 31.

Woman convicted of lover’s murder loses appeal

A woman convicted of fatally stabbing her lesbian lover has lost her appeal.

Nadisha Beckford is serving 42 years in prison after a jury found her guilty of murdering Lakeisha Mackey in February 2021.

Beckford unsuccessfully argued that the judge erred by admitting an audio recording in which she justified the stabbing and that her sentence was too harsh.

The appellate court ruled that the recording provided some evidence of self-defense.

Additionally, the Court saidthe audio recording helped the jury in assessing Beckford’s credibility.

In her interview with the police, she denied saying, “I’m a vampire I cut her throat and drink her blood”. However, the jury was able to hear her say that on the audio recording.”

The Court also found that the sentence imposed was not unduly severe.

Conviction upheld for man who fled home before cops found gun

The Court of Appeal has upheld the firearm and ammunition possession convictions of a man who allegedly left the door to his efficiency ajar as he fled from police.

Anwar Strachan will serve a total of three years for possession of an unlicensed firearm, possession of ammunition with intent to supply  and possession of a magazine.

The convictions stem from a police raid that took place on July 19, 2017 in Pinewood Gardens.

The officers, armed with search warrants, went to Numbers 4 and 5 Rosewood Street in search of drugs and firearms.

While at Number 5 Rosewood Street, Sergeant Taylor saw Strachan standing in the doorway of Number 4 Rosewood Street.

Strachan, according to the officer, ran away after he appeared to look in the direction of the officers.

They entered the one bedroom efficiency  in Strachan’s absence and found the contraband. Additionally, they found Strachan’s passport and voter’s card under the mattress.

When arrested many months later, Strachan admitted that he lived at the residence where the gun and bullets were found.

Strachan replied “no comment” when asked where he was when police searched his home.

He also answered “no comment” when asked the location of his passport.

Strachan didn’t testify at his trial.

Instead, he called a man who lived in the back of his home.

However, Strachan’s witness was unable to say whether he was at home when the police arrived.

The Court of Appeal said the conviction was reasonable given the evidence of the police witnesses.

Man charged with murder of missing man

Nassau, BAHAMAS- A former wanted suspect has been charged with the murder of a missing man.

Police say Ashton Sweeting is responsible for the murder of Murray Walkes, whose remains were found on a farm on Carmichael Road on July 12.

Walkes, 34, was reportedly with Sweeting when he was last seen alive on July 8.

Sweeting was not required to enter a plea to the murder charge when he appeared before Acting Chief Magistrate Roberto Reckley.

Bail was denied and he returns to court on October 24.

RBDF Officer accused of rape

A Royal Bahamas Defence Force officer accused of rape has been granted $9,900 bail.

Prosecutors have accused 41-year-old Valdez Lopez of the rape of a 28-year-old woman.

The incident allegedly took place on July 11.

Lopez didn’t have to enter a plea to the charge when he made his initial court appearance before Acting Chief Magistrate Roberto Reckley.

Reckley denied Lopez bail and remanded him into custody until October 19.

However, Lopez was granted bail by a Supreme Court judge a short time later during an emergency bail hearing.

Murder suspect killed in nightclub shooting

Nassau, Bahamas- Police are investigating a shooting inside a Fox Hill nightclub that left a murder suspect dead early Sunday morning.

Orlando Curtis was at Da Bing Nightclub when he was fatally shot during an altercation with another man.

The incident took place at 3am.

At the time of his murder, Curtis was on bail for the September 16, 2019 murder of Aurelio Deal at Armbrister Street, Fox Hill.

Deal, 19, was standing in front of a home when he was killed in a drive-by shooting.

Jury fails to reach verdict on rape of woman, 78

Nassau, BAHAMAS- A man accused of raping a 78-year-old woman faces the possibility of a retrial after a jury failed to reach a verdict.

However, the same panel convicted Charles Lightbourne of burgling the senior citizen’s home and beating her during the same incident.

Prosecutors accused Lightbourne, 50, of breaking into the woman’s home around 11pm on May 6, 2021, beating her and sexually assaulting her.

Lightbourne returns to court on September 7 for a sentencing on the burglary and causing harm charges.

It is up to the prosecution whether he will face a second trial for the rape.
