Man jailed for touching girl’s hip

NASSAU-A magistrate today jailed a man for one year after he admitted to touching an 11-year-old girl’s hip.

Tyrese Robinson, 25, of Derby Road, pleaded guilty to a charge of indecent assault regarding the May 11 incident.

The inappropriate contact occurred after the child took out Robinson’s cornrows, the court heard.

Robinson, a friend of the child’s mother, asked the girl if she could keep a secret before he caressed her buttocks, making her feel uncomfortable.

The girl didn’t keep Robinson’s dirty secret. Instead, she told her mother what he had done and her mother called police.


Robinson did not have a lawyer at his arraignment.

Prior to sentencing, Robinson asked Magistrate Samuel McKinney to show him mercy. He said was no longer welcome at the child’s mother’s home.

Robinson said he wouldn’t “do it no more.”

The magistrate asked Robinson if he had any children.

Robinson said he had two children, ages three and four. When questioned by the magistrate, he agreed that he wouldn’t want an adult to do the same thing to his children.

Robinson faced a maximum sentence of three years in prison; however, the magistrate imposed the one-year sentence due to his age and early guilty plea.

 

 

Nassau Village murder suspects arrested after chase

NASSAU-Police arrested two murder suspects who lead them on a brief chase.

The men, both ages 35, are suspects in the country’s 33rd murder that took place at Jackson Street in Nassau Village Sunday night.

According to police, the victim was on his porch when he got into an argument with two men around 11pm.

One of the men shot the victim multiple times during the dispute before they both fled in a white minibus. The gunshot victim died at the scene.

Police saw a minibus that matched eyewitnesses’ description of the getaway vehicle in nearby Pinewood Gardens.

And officers arrested the suspects after a short chase. However, they did not say that if they recovered a firearm.

Security guard fined for not wearing mask

NASSAU- A man arrested for not wearing a mask paid a $150 fine to avoid a one-month prison sentence.

Police locked up Devaughn Hepburn, 41, at around 11:50pm on June 20 for failing to wear a mask in public and breach of curfew.

When he appeared in court last week, the security officer admitted that he didn’t have on a mask when police stopped him. However, he said he didn’t break the curfew since he was headed to work.

After hearing his explanation, Deputy Chief Magistrate Andrew Forbes dismissed the curfew charge.

However, he convicted Hepburn of ignoring the requirement to wear a mask.

It’s been mandatory to wear protective masks since April 8. The requirement is one of the measures designed to slow the spread of the coronavirus pandemic.

On June 28, Prime Minister Dr. Hubert Minnis announced penalties for not wearing a mask. Violators could face a $200 fine and month in prison.

Business owners will also face fines if they don’t enforce the mask wearing rule for patrons.

Dr. Minnis said the first breach will attract a fine of $500. The fine doubles to $1,000 for a second infraction. After a third breach, the business could face temporary closure or a higher fine.

The requirement to wear masks in public is waived during exercise. However, the mask should be available and visible while working out.

Court orders retrial in rape case

NASSAU-The Court of Appeal has ordered a retrial for a Haitian man accused of rape.

Josue Celestin will face a second Supreme Court trial on claims that he raped the woman at his home.

The Court said it ordered a retrial in “the interests of justice.” The Court overturned Celestin’s conviction because the trial judge made a mistake during his summation.

At trial, Celestin called his accuser’s character into question by alleging she was a prostitute. According to him, she agreed to have sex for $50 but accused him of rape because he did not pay her.

For her part, the accuser said that Celestin threatened her with a screwdriver and made her perform various sex acts on November 9, 2015. Police found a screwdriver on Celestin’s dresser.


The Court of Appeal said Celestin did not have a fair trial because the judge failed to tell the jury about his good character.

Sir Michael Barnett said the trial judge has to ask if a good character direction is necessary whenever credibility is an issue.

Justice of Appeal Stella Crane-Scott agreed that the omission of the good character direction made the trial unfair.

However, Justice of Appeal Roy Jones disagreed. He said, “In my opinion, a good character direction to the jury would not have made a difference to the outcome of the case.”

Kendra Kelly appeared for the prosecution and Fedner Dorsetal represented Celestin.

 

 

2-year-old in critical condition after Eleuthera shooting

HATCHET BAY-Police have arrested two suspects in a shooting that left a two-year-old girl fighting for her life in hospital.

The incident happened around 10pm Saturday at Baby Johnson Lane in Hatchet Bay, Eleuthera.

According to police, DaNyla Roberts was in her grandmother’s lap when a car pulled up.

Three men got out of the car and approached the grandmother on her porch. One of the men shot at the woman after he made a comment. The bullet hit the child.

Little DaNyla was airlifted to New Providence for treatment to a gunshot wound to the abdomen.

She remains in critical condition. Investigations continue.


Meanwhile, in New Providence police are questioning a woman about a shooting.

Police received an alert about gunfire in the area of Comfort and Hay Streets around 6pm.

Officers on mobile patrol responded to the scene. They retrieved fired cartridges and learned that a Silver Nissan Cube had been damaged by gunfire. However, the driver left the scene before police arrived.

Acting on information, police went to Rupert Dean Lane where they found the damaged car. The officers later arrested the car’s driver for questioning.

Fire destroys yacht at Valentines Resort

HARBOUR ISLAND-A family is safe after their yacht caught fire at the Valentines Resort and Marina in Harbour Island on Saturday.

The fire completely destroyed the 66-foot Sunseeker with a reported value of $2.3 million.

The yacht’s owner Alejandro Capo, of Miami, Florida, four relatives and a captain were onboard when the fire started. But they jumped overboard and swam to safety.

No other boats were damaged.

Police are investigating the cause of the fire.

Warehouse workers accused of stealing cleaning products

NASSAU-Two former warehouse workers at Bahamas Wholesale Agencies faced theft charges after they allegedly failed to deliver cleaning products to Super Wash.

Jo-Delvano Archer, 35, and Emmanuel Kemp, 23, appeared before Deputy Chief Magistrate Andrew Forbes charged with stealing by reason of employment.

Prosecutors allege that the men stole five cases of pine cleaner, six cases of Ensueno fabric softener, 13 cases of flash cleaner, and 10 bags of Ruth laundry detergent from the company on June 9. The items have a value of $583.23.

Archer pleaded guilty to the charge. Magistrate Forbes fined him $500 and ordered him to reimburse the company the value of the stolen goods. If he doesn’t, he will spend six months in prison. Meanwhile, Kemp pleaded not guilty. The magistrate set his trial for October 7 and denied bail.

According to prosecutor Lincoln McKenzie, the warehouse manager called police after SuperWash failed to receive its complete order. Archer was responsible for the delivery.

During an interview with police, Archer admitted said he took the missing items to a place on Parkgate Road.

In mitigation, Archer’s lawyer Jomo Campbell said he had fallen “victim to the pressures of life.”

Campbell said Archer’s partner recently had twins and he was “overwhelmed with being a new father twice at one time.”

Man admits ATM deposit scam

NASSAU-A man has admitted to tricking a woman out of $500 in a phoney ATM deposit scheme.

Garshano Miller, also known as Shano Ellis, promised Shadia Darling $200 if she let him use her account to make a deposit.

Miller, 21, of Dorsett Alley, accompanied her to a Royal Bank of Canada ATM and handed her an envelope that she believed contained $2,500 cheque. Before the bank verified the deposit, Darling then withdrew $500 from her account and gave it to Miller. He promised that he would reimburse her once the deposit cleared.

Darling reported the matter to police when the bank informed her that she had deposited an empty envelope.

Miller pleaded guilty to charges of fraud by false pretenses and attempted fraud by false pretenses at his arraignment on Friday.


Deputy Chief Magistrate Andrew Forbes ordered Miller to repay Darling the $500 and to write her a formal apology.

Additionally, Miller has to complete 50 hours of community service and stay out of trouble for one year.

Miller will be sentenced to six months in prison if he breaches any of those conditions.

In mitigation, Miller’s attorney Joseph D’arceuil said the former bakery worker was remorseful.

D’arceuil asked the magistrate to be lenient since Miller did not have a criminal history.

He said the expectant father planned to enrol in an electrician course at the Bahamas Technical Vocational Institute (BTVI).

 

Man accused of indecent assault of girl, 8, denied bail

NASSAU-A 43-year-old man accused of the indecent assault of a child has been denied bail.

Prosecutors say Timothy Mario Jones, of United Estates, San Salvador, inappropriately touched the girl, aged eight, on March 1.

Jones did not enter a plea to the charge when he appeared before Deputy Chief Magistrate Andrew Forbes.

He’ll enter a plea once the case is sent to the Supreme Court. That will happen when Jones receives a voluntary bill of indictment (VBI) on October 26.

The magistrate denied bail. However, Jones can apply for bail in the Supreme Court.

Bahamians held in Jamaica over $2.6m ganja seizure

Jamaican narcotics police arrested three Bahamian men after the seizure of 2,600 pounds of compressed ganja.

Bahamas Court News has identified the men as Bartholomew Pinder, Ian Stewart and Patrick “PJ” Roberts.

Narcotics police and members of the Defence Force seized the ganja, worth $2.6 million, during an operation in Lancer Bay, Hanover on June 25.

Then, the operation team moved to Negril, Westmoreland, where they arrested the Bahamians.

Due to the COVID-19 pandemic, the suspects are in quarantine. They allegedly entered the country illegally.
