Man sentenced to probation for domestic assault

NASSAU-A magistrate sentenced a man to probation after he admitted a domestic assault.

Police charged Carlton Roker, 52, with causing harm after he hit his fiancée in the head with a cutlass during an argument on June 20. The incident happened at their home in Golden Gates.

Roker pleaded guilty to causing harm at his arraignment before Magistrate Sandradee Gardiner.

According to Roker, he’d been drinking at the time of assault.

He said the behaviour was out of character for him. He claimed that this was the first time that he’d assaulted his partner.

Roker told the court, “Me and her still in love. We live together. I just feel frustrated because I can’t find work.”

While agreeing that he had no reason to hit the woman, Roker asked the magistrate to show him leniency. He suggested that the court direct him to perform community service.

Instead, Magistrate Gardiner placed Roker on probation for a year. He’ll be jailed for the same period should he breach his probation.

Additionally, the magistrate issued a protection order that will remain in effect for two years. Roker will face one year in prison if he physically or verbally abuses his partner during this period.

Community service for man with fake IDs

NASSAU- A magistrate did not convict a man who presented two fake IDs to the National Insurance Board (NIB) cheque distribution site.

Instead, Magistrate Sandradee Gardiner ordered OcNeal Box to perform 500 hours of community service. If Box doesn’t complete the community service, he’ll spend six months in a prison.

Box, who is of Haitian descent, admitted to buying a Bahamian driver’s license and NIB smart card for $450, the court heard.

NIB fraud officer Jemma Hepburn called police for Box on June 26 after he presented the fake IDs.

The court heard that Ms. Hepburn checked NIB’s system and found the card number was assigned to O’Neil Dubois. However, no photo or supporting documents were in the system. Additionally, the NIB did not issue a smart card for the number.

As a result, Ms. Hepburn requested a second form of identification. That’s when Box presented the Bahamian driver’s license. Ms. Hepburn said she deemed both documents fake because they contained the same low resolution photo.

NASSAU-Prosecutors say they’ve found the man responsible for shooting a man outside his home.

Derinardo Mott, 26, appeared before Magistrate Samuel McKinney today charged with the attempted murder of Antoine Williamson on June 17.

According to police, Williamson and Kadisha Rolle were outside a home at Congo Court in Fox Hill when a gunman emerged from a white Honda Fit and opened fire.

Then, the gunman, who prosecutors say is Mott, escaped in the same car.

Mott faced a charge of possession of a handgun with intent to endanger the life of Ms. Rolle.

Additionally, prosecutors allege that Mott stole the 2002 Honda Fit used in the crime on June 15. They claim that he stole the vehicle from the Southwest Plaza between 10am and 5pm.

Mott did not have to enter pleas to the charges at his initial court appearance.

Magistrate McKinney denied bail and adjourned the matters to September 4. That’s when prosecutors will present a voluntary bill of indictment.

Serial scammer jailed for ATM cheque deposit scam

NASSAU-A magistrate on Tuesday jailed a serial scammer who tricked three people out of hundreds of dollars in a phoney ATM cheque deposit scam.

Jackson Colebrooke admitted to a scheme in which he deposited empty envelopes to his victims’ accounts and immediately withdrew money.

In total, Colebrooke scammed his victims out of $1,580.

He carried out the scam by convincing total strangers to deposit envelopes to their accounts that they believed contained cheques for $600, so that he could immediately access cash.

Colebrooke didn’t withdraw the total value of the “cheque”, giving his victims the impression that he had tipped them for their assistance.

By the time the unwitting men realised that Colebrooke had deposited empty envelopes, Colebrooke was long gone.

Colebrooke, 35, of Young Street, met all of his marks at Royal Bank of Canada ATMs.

Police eventually nabbed Colebrooke on June 25. And he gave arresting officers false names, leading them to charge him with deceit.

In court, Colebrooke apologised for duping his victims and he begged Magistrate Sandradee Gardiner for leniency.

He asked for the opportunity to repay his victims.

But, Magistrate Gardiner said reimbursement wasn’t an option for the repeat offender. And she jailed him for one year and four months.

This February, another magistrate allowed Colebrooke to repay a fraud victim to avoid two months in prison.

Magistrate Gardiner branded Colebrooke a “menace to society.” She said he had made a career by defrauding people out of their hard-earned money.

She urged Colebrooke to use his time in prison to learn a trade.

Colebrooke received a reduced sentence for his early guilty plea.

Suspended cop’s cleared of using excessive force

NASSAU-A police inspector accused of using excessive force now has the green light to return to work.

Prosecutors dropped the charges against Inspector Christian Leary when he appeared before the Police Disciplinary Tribunal on Tuesday, his lawyer Bjorn Ferguson said.

As a result, Inspector Leary’s suspension from duty came to an end. He will also receive backpay.

Police Commissioner Paul Rolle suspended Inspector Leary on August 27, 2017, after charging him with using unnecessary force against Aaliyah Bain and Deja Laing.

They claimed Inspector Leary punched them in the face during a traffic stop on August 4, 2019.

Photos of blood streaming from the torn eyelid of one of his accusers went viral.

Last month Justice Loren Klein issued an injunction halting the disciplinary action, pending the determination of a judicial review application.

Mr. Ferguson has alleged that the police made procedural missteps in bringing the charges against his client..

Inspector Leary, 38, in an affidavit filed last year, alleged that then-acting Commissioner of Police Paul Rolle, did not follow the Police Act.

According to him, the Police Force failed to follow “the disciplinary procedure set out by the Police Service Commission”.

Inspector Leary said, “I am innocent of all the offences and I am confident that I will be exonerated of the offences for which I am charged.”

Leary said the reduction in salary caused him “undue hardship and economic loss.”

This affected his ability to make payments on an outstanding loan at Bahamas Law Enforcement Credit Union.

Inspector Leary’s lawsuit is still pending.

NASSAU-A budget hotel fell victim to room theft.

A manager at Orchard Gardens Hotel off Village Road made a complaint to police after two blankets, a mirror, microwave and a mini fridge went missing from a room last month.

Police recovered the missing items, valued at $468.97, at the home of Shardone Russell, 20 and Troynique Stubbs, 20.

The women had stayed at the hotel before the items went missing.

They admitted to receiving the stolen items at their arraignment before Magistrate Samuel McKinney.

The court heard that the women confessed to bringing the stolen items into their home when questioned by investigators. However, they denied stealing the items themselves.

In mitigation, attorney Bjorn Ferguson said that both women, who are active in their church, “made a mistake by allowing the items on their premises.”

He asked the court to show leniency given their youth, early admission of guilty and previously clean records.

After chastising the women for their actions, Magistrate McKinney placed them each on probation for 12 months.

A probation breach will result in a three-month prison sentence.

Meanwhile, the third defendant Derek Nottage, 34, will go to trial on accusations of stealing and receiving on August 5.

The court released him on $500 bail.
