The Court of Appeal has upheld the firearm and ammunition possession convictions of a man who allegedly left the door to his efficiency ajar as he fled from police.
Anwar Strachan will serve a total of three years for possession of an unlicensed firearm, possession of ammunition with intent to supply and possession of a magazine.
The convictions stem from a police raid that took place on July 19, 2017 in Pinewood Gardens.
The officers, armed with search warrants, went to Numbers 4 and 5 Rosewood Street in search of drugs and firearms.
While at Number 5 Rosewood Street, Sergeant Taylor saw Strachan standing in the doorway of Number 4 Rosewood Street.
Strachan, according to the officer, ran away after he appeared to look in the direction of the officers.
They entered the one bedroom efficiency in Strachan’s absence and found the contraband. Additionally, they found Strachan’s passport and voter’s card under the mattress.
When arrested many months later, Strachan admitted that he lived at the residence where the gun and bullets were found.
Strachan replied “no comment” when asked where he was when police searched his home.
He also answered “no comment” when asked the location of his passport.
Strachan didn’t testify at his trial.
Instead, he called a man who lived in the back of his home.
However, Strachan’s witness was unable to say whether he was at home when the police arrived.
The Court of Appeal said the conviction was reasonable given the evidence of the police witnesses.
