Man wins $160k after cop knocked out his teeth

NASSAU- A man who lost six teeth after a policeman punched him during an unlawful arrest is set to receive $163,060.85 in compensation.

After the assault, Latario Rolle spent 10 days in custody on trumped up charges, which were eventually dismissed without a trial.

In a postscript to his ruling, Assistant Supreme Court Registrar said,  “There is no amount of money that could be awarded to restore the public’s confidence in Police when it has been eroded by abuse.”

Rolle’s ordeal began when police on patrol in Elizabeth Estates stopped him on Malaysia Avenue as he walked to his cousin’s home on to return a PlayStation game on January 9, 2015.

The officers searched Rolle without probable cause. During the illegal search, the officers found a photo of a gun on his cellphone.

When questioned about the location of the firearm, Rolle said it was just a photo from the internet.

The officers illegally arrested Rolle and took him to his home.

But Rolle didn’t have his keys and his grandmother wasn’t there to let them in.

That’s when the officers dragged the handcuffed suspect to the back of the house and pried the door open.

The officers ransacked the home and didn’t find a firearm.

So, they accused Rolle of being in unlawful possession of jewelry, a PlayStation console and games found in the home.

When Rolle asked how the police could break into his home and charge him for his own property, Corporal 2054 Moultrie charged at him and began punching him in the face. Moultrie, who has reportedly since retired, knocked out one of Rolle’s teeth and loosened another in the attack.

Rolle eventually lost six teeth as a result of the assault.

Police did not get Rolle immediate medical care, as required.

He was arraigned before on a magistrate on January 13, 2015 and granted bail.

However, Rolle’s was sent to prison after he didn’t post bail. He was released from prison on January 19, 2015.

Although the charges were dropped in November 2015, police did not return the items that were seized from Rolle’s home.

Rolle’s lawyer, Alton McKenzie, had sought $828,000 in damages.

The Attorney General’s Office lawyer Lynette King did not present a defense to the claims.

Toote said the failure to file submissions in defense “demonstrates an impenitent disregard to the plaintiff.”

Man cleared of murder back in jail on new charge

NASSAU- Months after he was acquitted of murder, Tarrico Bowleg has been accused of another.

Prosecutors say Bowleg killed Indian accountant Biswajit Pati in an ambush shooting outside his home on August 12.

Pati had just pulled up at his home in Tuckaway, off Village Road, when a lone gunman shot him nine times.

Pati died in hospital.

Bowleg did not have to enter a plea at his initial court appearance.

He was denied bail and will return to court on December 3.

In May, a jury acquitted Bowleg of the murder of Keion Butler and the attempted murders of Marvin Tilme and Chavez McPhee at Amos Ferguson Street on August 13, 2019.

He was granted bail for a 2019 gun case two weeks before prosecutors allege he killed Pati.

Rapper charged with two murders

NASSAU- Rapper Benji Jimbo was remanded to prison after being charged with two murders and two attempted murders.

Prosecutors say the rapper, whose real name is Braheem Charlton, is responsible for the August 9 murder of Dino Brown and the attempted murder of Dennis Bowles.

Both victims were shot in an ambush by two gunmen who emerged from a grey SUV, police said.

Charlton is also accused of the August 14 murder of Trainee Immigration Officer Laneisha Armbrister and the attempted murder of Drazen Dean.

The victims were stopped at an intersection in Victoria Gardens when the occupants of a grey SUV opened fire on their car, police said.

Charlton, 29, was not required to enter pleas to the charges when he appeared before Chief Magistrate Joyann Ferguson-Pratt yesterday.

He did not have a lawyer and returns to court on December 6.

 

Man acquitted of murder back in custody

NASSAU – A man who was recently acquitted of murder is the main suspect in last week’s slaying of Indian accountant Biswajit Pati.

He was ambushed and shot multiple times after he arrived at his home in Tuckaway, off Village Road, last Thursday. Pati died in hospital the following day.

The murder suspect, who is in his 20s, surrendered to CID with his lawyer. He is currently on bail for gun possession.

3 held in 94 pound ganja bust

NASSAU- Three men are in custody after the seizure of 94 pounds of marijuana with a wholesale street value of $94,000.

Officers from the Drug Enforcement Unit made the discovery while executing a search warrant on a home on Hawkins Hill Wednesday morning.

The officers found several crocus sacks containing marijuana during the search.

The DEU officers have arrested two Jamaicans and a Bahamian in connection with the seizure.

Man charged with murder despite alibi

NASSAU- Police have charged the wrong man with murder and attempted murder, according to his lawyer.

Brandon Pinder, 25, of Ridgeland Park West, appeared before Chief Magistrate Joyann Ferguson-Pratt charged with the August 9 murder of Dino Brown.

Prosecutors allege that Pinder killed Brown and attempted to murder Dennis Bowles in an ambush shooting in front of a home on Marshall Road.

However, defense lawyer Ian Cargill said Pinder has an alibi.

According to Cargill, he provided police with footage showing that Pinder was at home when the shooting took place.

Nonetheless, Pinder has been remanded to prison on the accusations.

He returns to court in December.

 

Lover wins battle for estate

NASSAU- Two women have lost a court battle against their father’s lover who inherited all of his belongings.

Reginald Major, who operated several businesses on Harbour Island, died on January 17, 2014.

Schikea and Travia Major, the deceased’s only children, were shocked to learn that their father had disinherited them in a will dated May 28, 2010.

Mr Major had left all his possessions to his daughters in a previous will dated July 21, 1998.

Family legacy

The daughters began court proceedings to declare the 2010 will that was executed while Mr Major was in hospital null and void.

They alleged that he was not in his right frame of mind due to the medication he was on.

Schikea testified that her father told her that all of his possessions belonged to his children and grandchildren. According to her, her father wanted them to continue his legacy by running the family business.

She said she did not believe that her father would disinherit his mother and children for Mary Thompson, a married woman.

Travia, Mr Major’s youngest daughter, said their father sent them money monthly and they helped to run the family’s businesses.

She said that their father told his workers that if anything happened to him to turn everything over to his daughters. Travia said her father would have told them if he had cut them out of his will.

14-year relationship

Thompson testified that she had known the deceased for 14 years. During that time, they vacationed together, lived with each other, and she conducted all his business.

Thompson said the only time Mr Major’s children checked on him is when they wanted financial assistance.

Thompson recalled that Mr. Major fell ill while in Nassau to attend her daughter’s wedding. She said she took him to the Walk-In Clinic, and he was admitted to the Princess Margaret Hospital.

X-rays showed he needed surgery to remove a mass from his lungs. Before the surgery, Mr Major instructed her to get a lawyer to execute a will.

She recollected him saying, “Mary you are the only one who has helped me in this life, and I want to leave everything to you in case something goes wrong.”

Thompson said when she asked what about his children, he replied, “What about them?”

She had the lawyer draft the will in accordance with his wishes. He signed the will two days before his operation in the presence of a nurse and Thompson’s brother.

According to Thompson, Mr Major had accused his children of stealing from him.

In dismissing the lawsuit, Justice Ian Winder said, “This was the absolute right of the deceased, as a testator is free to dispose of his property as he sees fit, and no heir, outside of a minor dependent, has any call on his property. It is not open to the Court to question the deceased’s motives in freely disposing of his estate.”

Justice Winder added, “What is also telling was the fact that the 2010 will was concluded almost four years prior to the death of the deceased. Had he been coerced or felt influenced to make the 2010 will, as is allegedly by the plaintiffs, it was open to him to make a new will, if he so wished.”

 

Woman killed, man in critical condition after shooting

NASSAU- A woman is dead and a man is fighting for his life in hospital after they were shot Saturday morning.

According to police, the victims were traveling in a black Toyota Passo in Victoria Gardens around 9pm.

The occupants of a grey SUV opened fire on their car while they were stopped at the intersection of Meadows Drive and Victoria Boulevard, police said.

Both victims were rushed to hospital by ambulance.

However, the woman died in hospital. The man is listed in critical condition.

Shooting victim dies in hospital

NASSAU- A murder investigation is underway after the victim of a shooting on Thursday died in hospital.

Indian accountant Biswajit Pati was ambushed by a lone gunman, who shot him multiple times outside his home, off Village Road, around 5pm.

Pati was in critical condition following emergency surgery yesterday. However, he died this evening.

Investigators are now trying to figure out who killed Pati and why.

Man denies slapping woman’s butt

NASSAU – Police have charged a man with indecent assault after he allegedly slapped a woman’s butt.

Ricardo Gibson, 23, has denied hitting the 34-year-old woman’s rear end without her consent on August 8.

Senior Magistrate Derence Rolle-Davis set Gibson’s bail at $2,500.

Gibson is next due to appear in court on October 27.
