Court upholds gun convictions of car passenger

NASSAU -The Court of Appeal has upheld the firearms convictions of the front seat passenger in a car.

Jason Ferguson was sentenced to 2 ½ years in prison, plus a $10,000 fine for possession of two .45mm pistols. He will serve an additional year if he doesn’t pay the fine.

Police on patrol on Montrose Avenue around 3:45am on August 4, 2018 came across a heavily tinted Chevy Cruze that was speeding.

The officers pursued the car while sounding their foghorn and flashing emergency lights.

However, the car’s driver, Hubert Mackey, ignored the commands to stop and led police on a high-speed chase.

Eventually, the chase ended near St. Barnabas Church on Wulff Road.

The officers ordered the four occupants out of the vehicle and searched it in their presence.

Immediately, the officers saw two loaded .45 Glock pistols in the center console between the driver’s and passenger’s seats.

Mackey, a mechanic, said the car belonged to a customer who needed the brakes replaced. He testified he didn’t see any firearms when the owner handed the car over.

In February 2021, Magistrate Samuel McKinney convicted both Mackey and Ferguson, finding that they had knowledge and possession of the firearms right next to them.

Magistrate McKinney acquitted the backseat passengers at the close of the prosecution’s case.

Justice of Appeal Jon Isaacs said the magistrate was entitled to conclude that Ferguson and Mackey were acting in concert in possessing firearms and ammunition.

Additionally, he said there was no evidence that the backseat passengers knew the guns were in the car.

Given that Ferguson faced a potential of 10 years’ imprisonment, Justice Isaacs did not find the sentences were unduly harsh.

Public defender Stanley Rolle represented Ferguson and Stephanie Pintard appeared for the prosecution.

NASSAU- A four-year-old girl has died from injuries associated with severe sexual abuse.

The toddler was taken to hospital Friday night with injuries.

However, doctors could not save her.

Police are questioning the child’s mother and boyfriend about the tragic incident.

Man charged with Lyon Road shooting

NASSAU- A man accused of injuring a man in a shooting last month has been charged.

Shon Butler, 21, allegedly shot Lamont “L Boy” Burrows multiple times at Lyon Road on October 28.

Burrows was standing in the street when prosecutors allege Butler shot him multiple times.

Butler, also known as Lil Shon, made his first appearance before Magistrate Algernon Allen Jr charged with attempted murder and possession of a firearm with intent to endanger life.

He was denied bail and will return to court on February 15, 2022.

Bahamian captain pleads guilty to human smuggling

FLORIDA -A Bahamian boat captain who led authorities on a chase with 16 undocumented immigrants onboard has pleaded guilty to federal human smuggling charges.

Jeremy Christoph Rolle, 26, pleaded guilty this week to aiding and abetting immigrants to enter the United States.

His sentencing is set for January 11, 2022. Rolle faces up to 10 years behind bars.

Rolle was arrested on June 17, 2021. He started the smuggling venture in Bimini, Bahamas.

His vessel started to take on water at the Hillsboro Inlet; however, he refused help from an employee of a boat towing company.

A short time later, Broward County Sherriff’s Office Deputy on marine patrol came across Rolle driving the 26-foot boat.

Rolle ignored commands to stop and led law enforcement on a pursuit through the Intracoastal Waterway. During the chase, Rolle made initial landfall at a seawall on the western side of the Intracoastal Highway. Upon landfall, several people ran from the vessel onto land who were later caught by BSO deputies.

The chase ended after Rolle crashed the boat filled with several migrants still on board into a seawall in Pompano Beach.

Three previously removed immigrants were onboard Rolle’s boat. They are 54-year-old Andrew Devaunx of the Bahamas and 42-year-old Marvin Morris Carridice of Jamaica, who illegally re-entered the U.S. after being deported following aggravated felony convictions.

Additionally, 27-year-old Payam Hassanzadeh Zargar of the United Kingdom illegally reentered the United States after being previously removed.

 

 

 

 

 

2 charged in hold-up at Exuma store

NASSAU- Two men have been charged for their alleged involved in an armed robbery at Smitty’s Convenience Store in Exuma.

Prosecutors allege that  Chando King, 24, and Kenneth Mortimer, 23,  were armed with a knife and handgun, when they robbed two of the store’s cashiers of a total of $1,240 on October 29.

Police arrested the Exuma residents two days after hold-up.

And officers allegedly found the men with a 9mm pistol and two rounds of 9mm ammunition.

They were not required to charges of armed robbery, possession of a firearm and possession of ammunition when they appeared before Magistrate Kara Turnquest -Deveaux today.

She denied them bail and set February 4 at their next court date.

Teen accused of robbing delivery man of pizzas

NASSAU- A teen has been charged in connection with the armed robbery of a pizza delivery man last month.

The victim thought he was making a routine pizza delivery on October 15.

Instead, he was allegedly accosted by a 16-year-old boy who was armed with a cutlass.

The teenager, who cannot be named because he’s a minor, is accused of robbing the delivery guy of two pizzas valued a $90.29, the property of Marco’s Pizza.

He also allegedly robbed the pizza guy of $34 of his personal funds.

The minor did not have to enter a plea when he made his first court appearance today.

He’s been denied bail and remanded to the Simpson Penn School For Boys.

Boat stolen in Florida found in Freeport

A boat stolen in Florida was found in Freeport, Grand Bahama.

Acting on information, officers from the Marine Unit went to an apartment complex on Kings Road on November 3.

The officers found a tan 26-foot Scott hull with a 250 horsepower outboard engine.

Police said the boat had no registration and was damaged.

They later learned that the owner had reported the boat stolen from Pompano Beach.

Investigations are continuing.

 

 

No penalty for priest’s son on bullets rap

NASSAU- A priest’s son will receive no criminal record for possession of ammunition.

Police arrested Etienne Bowleg Jr after they found three rounds of ammunition inside a Ford Expedition owned by his father following a high-speed chase in 2009.

Justice Cheryl Grant-Thompson ordered Bowleg to keep the peace for one month after he pleaded guilty to possession of ammunition.

The Court directed jurors to acquit Bowleg of charges related to an alleged shootout with police after the prosecutor offered no evidence in support of the allegations.

Prosecutors had alleged that Bowleg had a firearm with the intent to put the lives of Reserve Constable 26 Dennis Clarke, Reserve Constable 775 Patrick Minnis, Constable 2895 Shenique Ford and Sergeant 987 Alexander Pierre in fear.

While on bail for the charges, Bowleg was allowed to travel to Florida to comply with probation conditions imposed by a court there.

Landlady accused of pulling gun on tenants

NASSAU- A landlady and two others have been denied bail over claims that they pulled a gun on tenants in a rent dispute.

Prosecutors allege that landlord Michelle Williams, 53, her daughter Michelle Williams, 32, and Richard Armbrister, 35, while concerned together, pulled a handgun on Adrian Cooper and Savannah Bain with the intent to endanger their lives on October 28.

They did not have to enter pleas to the charge when they appeared before Magistrate Kara Turnquest-Deveaux.

She remanded them to prison—but advised them of the right to seek bail in the Supreme Court.

Also, Armbrister faces a charge of possession of an unlicensed firearm and ammunition.

The charge stems from claims that police seized a 9mm pistol with seven rounds of ammunition from Armbrister on November 1.

He has pleaded not guilty.

Both matters have been adjourned to February 4, 2022.

 

Wounded shooting suspect arrested at hospital

GRAND BAHAMA – Police arrested a suspect in an attempted murder when he showed up at the hospital for treatment.

Investigators believe that the suspect was injured by police in a shooting Wednesday night.

It started around 10pm when police officers at a business in Marsh Harbour, Abaco saw a gunman chasing another man.

The victim fell to the ground and the gunman stood over him and shot him multiple times.

The officers sprang into action and identified themselves as police officers.

The gunman pointed his firearm at the officers and fled.

One of the officers fired at the assailant, who managed to escape.

The gunshot victim was taken to the Marsh Harbour Clinic. He was airlifted to New Providence in serious condition.

Meanwhile, the suspect in his shooting showed up at the Rand Memorial Hospital around 6am.

He was treated for a gunshot wound that he claimed he sustained while at Eight Mile Rock.

However, investigators later learned that he was the suspect in the shooting in Abaco.

Police arrested him in relation to that matter after he was released from hospital.
