Cops search for gunman as motorcyclist shot

NASSAU-Authorities are searching for a gunman who shot multiple times at a motorcyclist Saturday morning.

The shooting occurred at 11am as the motorcyclist headed east on the Charles Saunders Highway.

The victim told police that he heard three gunshots coming from nearby bushes before he realized he was shot in the left thigh.

The victim remains in stable condition in hospital.

The motive for the shooting is unknown.

Worker who failed to detect theft wins wrongful dismissal suit

NASSAU-The longest serving employee at Battery and Tyre Specialists has been awarded $33,020 after winning a case for wrongful dismissal.

Ms Hall, an accounts supervisor, had worked at the company for 27 years when her bosses fired her without warning on April 4, 2018.

Ms. Hall’s bosses alleged that she negligently failed to detect the theft of over $400,000 that her supervisors and the company’s external accountant had missed.

Prior to Ms. Hall’s dismissal the company fired cashiers Alice Murphy, Anthonique Bowleg and Shalecia Bannister after accusing them of the theft over a two-year period. They are still awaiting trial.

Carl McCartney, the company’s inventory manager, reported the matter to police when he allegedly found discrepancies in sales returns. He allegedly saw the cashiers pocketing money after viewing surveillance footage.

By contrast, Ms. Hall did not have access to the surveillance footage.

Ms. Hall was on vacation when Battery and Tyre Specialists fired the cashiers for the alleged theft.

Then, the company fired her without notice, one day after she returned from vacation.

As a result, she filed a trade dispute against Battery and Tyre Specialists alleging wrongful dismissal.

No Knowledge

Ms. Hall’s lawyer Bjorn Ferguson argued before the industrial tribunal that she had no knowledge of the fraud or theft.

In fact, he said Desiree McCartney, the company’s vice president and manager of accounts, had responsibility for overseeing the cashiers, as their direct supervisor, and had also failed to detect the fraud.

In response, Cathleen Johnson-Hassan claimed that Ms. Hall supervised the cashiers. She asserted Ms. Hall should have detected the fraud since it happened while she was at work.

She argued that Ms. Hall’s behavior was suspicious because she said nothing about the absence of the fired cashiers, whom she had a close relationship with, when she returned to work. And when told about the alleged fraud, she wondered what they did with the money.

The tribunal found that Ms. Hall did not supervise the cashiers. Additionally, Ms. Hall did not authorise refunds or returns.

The tribunal found was no evidence that the company reasonably believed that Ms. Hall committed gross negligence, or knew about the fraud. Additionally, the Tribunal determined that the company had failed to conduct a reasonable investigation to support its belief.

Lastly, the tribunal found that Ms. Hall’s friendliness with the fired cashiers was not evidence that she knew about the alleged theft.

 

RBDF officer arrested after drug find

NASSAU-Police arrested a Royal Bahamas Defence Force officer after they allegedly found drugs in a car.

Officers from the Operations Unit stopped the car near Simms Street and Maxwell Lane around 4pm Friday. They said the occupants of the car were behaving in a suspicious manner.

The officers allegedly found marijuana in the vehicle during a search.

As a result, the officers arrested the RBDF officer and another man.

Man arrested for kissing boy

NASSAU-Police arrested a man after he allegedly kissed a boy on his mouth Friday night.

According to police, the incident occurred while the child was at a party with his mother.

She reported that a man grabbed her son and forcibly kissed him on the mouth.

When the child tried to break free and scream, the man allegedly covered his mouth and ran away.

Acting on the mother’s complaint, arrested the man on suspicion of indecent assault.

Police did not give the age of the child or the suspect.

NASSAU-Officials have launched an internal investigation into a viral video of a courtroom party

Bahamas Court News understands that officers from the court’s cellblock held the party on July 9. They reportedly moved the party into Magistrates’ Court Number 5 after it got “too hot.”

Police have prosecuted numerous civilians for not wearing masks or following social distancing guidelines.

Despite this, none of the court staff or police officers seen in the video wore masks. Neither did they adhere to social distancing guidelines.

The chief magistrate and chief justice issued a joint statement on the matter today.

The statement said, “We are cognisant of the importance of preserving the decorum of court buildings and the dignity and fairness of court proceedings.

“For these reasons, we regard the incident shown in the video as a serious matter, which requires our attention and urgent action.”

 

Alleged Jamaican gang leader facing deportation

Alleged Jamaican gang leader George Ellis is facing deportation after admitting a drug possession charge.

When police announced Ellis’ arrest on July 1, they described him as a “known hit man” with ties to the No Dollars, No Cents gang.

Officers arrested the 30-year-old at the Victoria Inn on Midshipman Road.

Ellis, known by the street name Boom, was handed over to immigration officials after he paid a $400 fine for the drug case.

According to police sources, Ellis was not in the country to carry out a contract killing as they initially believed.

They believe he was headed to the US but got stuck in The Bahamas when the borders closed due to the COVID-19 pandemic.

In November 2019, Jamaican prosecutors withdrew charges of gang recruitment against Ellis after the murder of their main witness.

Police shoot, kill pit bull dogs

NASSAU-Police shot and killed five pit bull dogs in Bel Air Estates yesterday.

The shooting culminated a police chase, according to an eyewitness.

It all began when police showed up at the funeral repast of murder victim Peron Bain, which was held on the park in the neighbourhood.

Bain, an alleged gang member, was gunned down in the area on May 29.

The repast attendees ran when the police arrived, and, the officers allegedly fired shots at them.

The men ran through a neighbour’s yard. However, the suspects were “long gone”, by the time the officers went into the yard, the witness said.

According to the witness, the dogs posed no threat to the officers.

The animals belonged to a dog breeder, the witness said.

Man jailed for jet ski theft

NASSAU-A magistrate jailed a man who stole a jet ski from a home at Old Fort Bay.

Police caught Tyrese Boodle, 20, with the stolen Yamaha jet ski at Goodman’s Bay, the court heard.

Boodle, a jet ski operator, told investigators that he went to Andy Landsky’s home by jet ski, followed by two others.

Boodle said they used a rope to pull the jet ski, worth $13,500, from the owner’s deck. However, his accomplices remain at large.

Surveillance cameras captured the theft.

Boodle pleaded guilty to stealing at his arraignment before Senior Magistrate Derence Rolle-Davis.

Defence lawyer Alex Morley asked the court to consider community service instead of a prison sentence.

In sentencing Boodle to one year in prison, Magistrate Rolle-Davis said that he did not deserve the maximum of seven years; however, he could not “go unscathed.”

The magistrate said he hoped that Boodle would be rehabilitated in prison.

Man smashed girlfriend’s phone and laptop in row over cheating

NASSAU-A jealous man flew into a rage after his girlfriend received an early morning phone call.

Jamain Higgs, 38, of Shady Tree Street, suspected that the woman was chatting with another man because she wouldn’t let him hear the 5am conversation on March 8.

So, Higgs grabbed the Samsung A20 cellphone and smashed it up.

Later that evening, the couple had another bust-up over accusations of cheating.

On that occasion, Higgs threw an HP laptop on the ground and then stomped on it.

Higgs pleaded guilty to two counts of causing damage at his arraignment before Senior Magistrate Derence Rolle-Davis on Friday.

Attorney Allen Emmanuel said that Higgs was no criminal. Mr. Emmanuel said the construction worker had lost control of his emotions, adding that he had bought the items that he destroyed for his now former girlfriend.

At the time Mr. Emmanuel said that Higgs lived with the woman and their daughter. They’ve since parted ways. But Higgs still supports his child, Mr. Emmanuel told the court.

Magistrate Rolle-Davis ordered the Higgs to compensate his ex $462.69, the value of the items. Higgs paid the money and received an absolute discharge.

Man accused of raping daughter

NASSAU- A 32-year-old man accused of raping his own daughter has been denied bail.

Prosecutors say the resident of New Providence first molested the child when she was 10. The alleged victim is now 12.

They allege that the man made his daughter perform oral sex on him.

Prosecutors say he first molested his daughter in 2018. Then, he allegedly committed additional incestuous acts in February and April of 2020.

The man’s name has been withheld to protect the child’s identity.

The suspect did not have to enter pleas to three counts of incest when he appeared before Chief Magistrate Joyann Ferguson-Pratt today.

The magistrate refused him bail. However, the man can seek bail before a Supreme Court judge. The suspect returns to court on October 14
