Tribunal upholds dismissal of worker who failed drug test

NASSAU- The Industrial Tribunal has ruled against a BPL worker who challenged her dismissal for failing a drug test.

Tabitha Smith was let go in 2018 after she tested positive for marijuana during a random drug test.

In her defense, Smith claimed she was using medical marijuana prescribed by a doctor in Coral Gables, Florida.

However, she didn’t present any medical evidence to support this claim during the hearing before the tribunal.

Human resources manager Chequita Johnson testified that Smith gave various reasons for her positive drug test before claiming she had used medical marijuana.

The power company bans the use of narcotics unless prescribed by a medical practitioner.

Before claiming medical use, Smith allegedly told Ms Johnson that she had attended a party where others were smoking marijuana.

Then she claimed that she unknowingly drank marijuana tea.


Tribunal Vice President Marilyn Meeres said that Smith was unable to provide the court with a copy of alleged prescription for medical marijuana.


As a result, Meeres rejected the claim for wrongful dismissal.

Man spared jail after slashing girlfriend with knife

NASSAU- An abusive man has been spared jail time for slashing his girlfriend in the thigh.

Tyrone Culmer, 43, without warning attacked K. Prosa on September 24.

They were sitting on the bed of an apartment in Blue Hill Heights when Culmer complained that he couldn’t see the TV.

He placed Prosa in a headlock, punched her in the face and stabbed her in the thigh after she replied,  “What do you want me to do?”

Culmer destroyed Prosa’s $200 cell phone during the attack.

Unlike most domestic abuse victims, brave Prosa didn’t withdraw her complaint.

But the magistrate failed to ensure that Culmer didn’t attack another woman.

Magistrate Derence Rolle-Davis could have jailed Culmer for up to seven years for causing grievous harm.

But he wont serve any time at all, if he compensates Prosa $863.50 for medical expenses and the damaged phone.

The court also ordered Culmer to stay away from Prosa for one year and attend anger management classes for six months.

He risks spending 18 months in jail by failing to meet those conditions.

On Monday, police said a man killed 30-year-old Alicia Sawyer and her eight-year-old daughter.

The prime suspect had a history of domestic abuse and served just two years of a three-year sentence for breaking into his ex-girlfriend’s home and shooting her in the leg.

Shooting suspect charged with attempted murder

NASSAU- Police have charged a man with two counts of attempted murder over a shooting in Coconut Grove.

Prosecutors say Dave Miller Jr, of Key West Street, is responsible for the September 22 shooting of Lukson Veus and Ahmad Clarke at Acklins Street.

Miller, also known as LiL Dave, didn’t have to enter pleas to the charges when he appeared before Senior Magistrate Derence Rolle-Davis.

He’s been denied bail. The matter has been adjourned to December 2.

Club owner dies in shooting

NASSAU- The owner of the New Village Pub is dead after he was shot near the establishment on Balfour Avenue tonight.

Roberto Williams, 46, was accused in August of operating a non-essential business in violation of COVID-19 emergency orders.

Williams, who also used the surname Lewis, was due to appear in court on October 14 for trial.

Murder suspect granted bail after four weeks in jail

NASSAU- A murder suspect will walk out of prison after spending almost four weeks in jail.

Justice Deborah Fraser today set bail at $30,000 with two sureties to Jared Albury.

As a condition of bail, Albury has to wear an electronic monitoring device.

The 27-year-old is charged with the August 25 murder of Stancel Todd at Pinedale Road. Chief Magistrate Joyann Ferguson-Pratt remanded him to prison on the murder charge on August 31.

Prosecutors say that Albury fatally stabbed Todd during a fight outside a business.

Attorney Bjorn Ferguson represented Albury at the bail hearing and Algernon Allen Jr appeared for the prosecution.

Man arrested for weed birthday gift

NASSAU-A man’s birthday celebration went up in smoke after was arrested for a joint over the weekend.

Bryan Pearce spent the weekend in custody because the Exuma resident didn’t have anyone to sign his police bail.

He pleaded guilty to marijuana possession at his arraignment on Monday.

The court heard that Pearce was at a stall on Potters Cay Dock when an officer searched him and found the ganja in his pocket.

Pearce told the officer that he was celebrating his birthday.

When he appeared in court, Pearce claimed a friend gave him the joint after wishing him happy birthday.

Pearce said, “I don’t even smoke like that. I just put it in my pocket.”

The $5 gift didn’t end in a conviction for Pearce.

Deputy Chief Magistrate Andrew Forbes placed him on probation for six months.

He’ll serve one month if he violates probation.

Four plead guilty to COVID-19 unemployment fraud

A magistrate on Monday ordered three men and a woman to repay the $24,102.47 that they received in unemployment benefits to avoid spending six months in jail.

Brian Cooper, Quentin Rahming, Santoine Major and Kaylisa Miller on Monday, September 28 admitted to fraudulently obtaining relief funds for people who lost their jobs due to COVID-19.

According to prosecutors, they were recruited to participate in massive scam that defrauded the government fund out of $123,000.

Although they weren’t entitled to payments, Cooper and Rahming each received cheques for $4,256.89. Major received a cheque for $4,125 and Miller got a cheque for $3,081.80.

After cashing the cheques, they gave the money to the unidentified recruiter, who gave them $300 to $500 for themselves, the prosecutor said.

Deputy Chief Magistrate Andrew Forbes warned the crooks that they’d go to prison for six months if they don’t reimburse the government by October 30.

NIB manager Dino Dean allegedly orchestrated the fraudulent scheme.

Dean allegedly approved the bogus unemployment claims by making false entries in NIB’s V3 system.

Dean faced charges of forgery, falsification of accounts, money laundering, fraud by false pretenses, and conspiracy to commit fraud by false pretenses and was denied bail.

Other alleged participants in the scheme are: Leroy Poitier, Latoya Neely, Ashanique Neely, Gary LaFleur, Lakeisha Tucker, Gillian Thurston, Ray Rigby, Thio Rolle, Gadville Woodside, Jermaine Evans and Takia Smith.

They entered not guilty pleas to charges of fraud by false pretenses and money laundering and were denied bail.

However, they can apply for bail in the Supreme Court.

Magistrate Forbes will begin the trial on February 9.

Mother, daughter killed in domestic dispute

NASSAU-Two people are dead as the result of a domestic dispute.

A woman, in her 30s, and her 10-year-old daughter were found dead inside their home at Stack Avenue in Nassau Village.

Police spokesman ASP Audley Peters said investigators are following a significant lead in the double murder that he described as a domestic incident.

Thief caught by photo of stolen goods

NASSAU-Police caught a brazen thief who took a photo wearing a stolen watch and earrings.

Lashan Rolle, 26, posted the photo online days after she swiped the items while visiting a friend.

Waltia Burrows couldn’t find her Apple watch, Pandora necklace and charm, Michael Kors watch and a pair of replica David Yurman earrings after she invited friends to her home on September 12.

But Ms Burrows learned the thief’s identity when Rolle posted a photo wearing the Apple watch and earrings—and gave the police name of the suspect.

Police arrested Rolle and recovered the stolen watch and earrings.

Rolle pleaded guilty to stealing when she appeared before Deputy Chief Magistrate Andrew Forbes.

He placed Rolle on probation for 12 months and ordered her to perform 100 hours of community service. Additionally, Rolle has to pay Burrows $595 in compensation for the stolen items that weren’t recovered.

Rolle will spend six months in prison for failing to comply with any of these conditions.

Man accused of sex crime against minor denied bail

NASSAU-A man accused of the rape of a minor has been denied bail.

Prosecutors say Leonard Brown, 44, of Elizabeth Estates, had unlawful sexual intercourse with a 13-year-old girl in June. The age of consent is 16.

Brown did not have to enter a plea to the charge when he appeared before Assistant Chief Magistrate Subusola Swain on Friday.

Brown returns to court on November 16 to receive at voluntary bill of indictment.
