Refugee bailed on fake driver’s license charge

Nassau, BAHAMAS- A political refugee from The Gambia has been granted bail after being accused of having a fake Bahamian driver’s license.

Ousman Bojang was arrested on July 21 after he allegedly presented the forged driver’s license to a policeman.

He denied charges of possession of a forged document and uttering a forged document at his arraignment on July 24 and was denied bail.

Bojang, who was granted political asylum on August 5, 2020, was granted $9,500 in the Supreme Court on August 10.

Bojang arrived in The Bahamas on December 5, 2015 and was granted a 14-day visitor’s visa. At that time, he didn’t tell immigration officers that he was seeking asylum.

He was arrested on December 30 of that year for overstaying when he went to the Immigration Department seeking an extension of his visa. Once again, Bojang did not say that he was seeking asylum.

Attempts to repatriate Bojang were unsuccessful and he was detained until a judge ordered his release on June 16, 2017.

In August 2022, then Senior Justice Indra Charles awarded Bojang $166,100 in damages after finding that his detention was unlawful because he had not been convicted of an offense and authorities had failed to get a deportation order.

Bojang, who had initially sought $1 million in damages, is appealing the award.

Man jailed for indecent assault of girl, 8

Nassau, BAHAMAS- A man who was 43 years old when he indecently assaulted his eight-year-old neighbour has been jailed for four years.

The man, 45, pleaded guilty to the charge in the middle of his trial.

He faced a potential maximum sentence of 10 years’ imprisonment.

The victim went to the man’s home to play with his daughter, and the convict suggested a game of hide and seek.

He sent his daughter outside and suggested that the young victim hide in the bedroom.

There, he blindfolded her with a head cloth. The child said the man unzipped his pants and stroked her hand against his genitals for several minutes.

Sick gun-toting grandma seeks sentence cut

Nassau, BAHAMAS- A gun-toting grandmother has asked the appellate court to reduce her one-year prison sentence, arguing that she’s too sick for jail.

Freda Hart, 80, was convicted of gun possession in February 2023 after she tried to hide a loaded gun from police.

Hart has already served six months of her sentence for possession of an unlicensed firearm and possession of ammunition. Persons convicted of firearms offenses do not receive time off for good behavior.

On December 1, 2020, police officers armed with a search warrant in her grandson, James Hart’s name, descended on their shared home.

Ms Hart, then 79, devised a plan to hide the gun. She asked the officers to use the bathroom and took a towel with her.

When an officer tried to take the towel away from her, Ms Hart reportedly scuffled with the policewoman.

During the struggle, a loaded 9mm pistol, which was in the ready-to-fire position, fell to the ground.

Hart’s lawyer, Caleb Dorsett, presented medical evidence that was not before the magistrate in an effort to show that the sentence was too harsh.

He said that his client suffered from hypertension and dementia.

Nevertheless, Justice of Appeal Jon Isaacs noted that she had the mental capacity to think of a way to discard the firearm.

The prosecutor, Ashley Carrol, defended the one-year sentence, saying it was reasonable given the circumstances of the case.

The Court of Appeal has reserved its decision on whether Hart’s sentence was too harsh.

Hart’s grandson was sentenced to 30 months’ imprisonment. He has not filed an appeal.

Man arrested for stabbing his neighbour

Nassau, BAHAMAS- A man is under arrest after he allegedly stabbed his neighbour in a fight.

According to police, the 26-year-old was at his home when he got into an altercation with his 19-year-old neighbour, who allegedly stabbed him multiple times about the body.

Police said the stabbing victim is in serious condition at the hospital

Slack cop can face charges over ‘stolen’ patrol car

Nassau, BAHAMAS- A junior officer could face disciplinary charges after a police patrol car that he left unattended with his engine running outside the Quakoo Street Police Station was ‘stolen’ on Thursday night.

When the officer went outside the patrol car was gone, leading him to call Police Control Room to report the vehicle stolen.

However, this wasn’t the case. The irresponsible officer’s supervisor had driven off in the car after finding it unattended.

$30k bail for man accused of jailhouse plot to kill cop

Nassau, BAHAMAS- A man accused of plotting to kill a cop attached to the homicide squad has been granted bail.

Prosecutors say Roger Wallace planned the murder of Sergeant Raphael Miller while he was locked up for two murder cases.

Wallace and his co-defendant Aljaron Stubbs are accused of conspiracy to commit murder.

The charge is based on a voice-note that allegedly said, “Officer Miller won’t stop until four rifle man pop up at his door and (expletive deleted) his head.”

In arguing for bail, Cassie Bethel said that the prosecution had no evidence to show that there was a plan or agreement to commit murder.

Additionally, she pointed out that the alleged recording referred to Officer Miller and not Sergeant Raphael Miller.

The prosecution, on the other hand, asserted that Wallace had a tendency to commit crimes.

Noting that Wallace had no prior convictions and was presumed innocent, Justice Camille Darville-Gomez set his bail at $30,000.

Wallace has to wear an ankle bracelet, keep a curfew and sign in a a police station three times a week. He’s also prohibited from contacting prosecution witnesses directly or through his agents.

Lindsay Shiver freed on $100k cash bail

Nassau, Bahamas- An American woman accused of conspiring to murder her husband was freed on $100,000 cash bail on Wednesday.

Lindsay Shiver appeared in the Supreme Court alongside her alleged lover Terrance Bethel and Faron Newbold Jr, the man they allegedly enlisted to carry out their murderous plan.

Shiver, Bethel and Newbold spoke to each other as they sat in the prisoner’s dock—the first time they were together after being remanded to prison on July 28.

Prosecutors say the trio discussed plans to murder Shiver in a series of WhatsApp messages.

Police accidentally stumbled upon the plot while searching Bethel’s cellphone as they investigated a break-in at the bar where he worked in Guana Cay, Abaco.

The accused were granted emergency bail on August 1 after the chief prosecutor withdrew an initial objection to their release after she spoke with their intended target.

Newbold and Bethel were each freed on $20,000 bail on August 3 on the condition that they wear an ankle bracelet, keep a daily curfew and check in at the Marsh Harbour Police Station three times a week.

Shiver remained in custody until today because she needed to provide the court with an address.

Her lawyer Cassie Bethel presented the court with a copy of a lease agreement and asked that she be permitted to check in at the Cable Beach Police Station.

An official from the U.S. Embassy was present to take custody of her passport.

Meanwhile, attorney Owen Wells, told the court that Newbold and Bethel needed new charging devices for their ankle monitors.

All of the accused are banned from coming within 100 feet of Mr Shiver.

Visits with Mrs Shiver and her three sons, ages four, six and 10, will be facilitated by their maternal grandmother.

Lawyer seeks immediate bail for MP accused of rape

Nassau, BAHAMAS- A member of the governing Progressive Liberal Party is expected to be granted immediate bail after facing charges of rape, assault and threats of death.

Kirk Cornish, 48, the MP for North Abaco, is accused of raping a 35-year-old on March 25 and April 4.

The March incident allegedly took place in Nassau and the second rape allegedly happened in Cooper’s Town, Abaco.

Cornish is also accused of assaulting the woman on January 20 and March 25.

He’s also accused of threatening to kill the same woman on April 4.

Cornish was not required to enter pleas to the charges since he will be tried in the Supreme Court.

Acting Chief Magistrate Roberto Reckley remanded Cornish to prison until October 17.

However, his lawyer Owen Wells said that he would seek bail immediately.

The criteria for emergency bail is if the applicant is sick, pregnant, a juvenile or elderly and if the prosecution has no objection.

The prosecution is not expected to oppose the bail application.

Unlike most defendants facing serious charges, Cornish was neither handcuffed nor shackled when he appeared in court.

Assistant Superintendent of Police Philip Davis was the prosecutor.

Man accused attempted rape of tourist

Nassau, BAHAMAS- A Bahamian man was remanded to prison on Monday after being accused of trying to rape an American tourist.

Prosecutors allege that George Osteen attempted to rape a 20-year-old cruse ship passenger on August 2.

The incident allegedly took place at Junkanoo Beach.

Osteen was not required to enter a plea to the charge when he made his initial appearance before Acting Chief Magistrate Roberto Reckley.

Bail was denied and he returns to court on October 26 to receive voluntary bill of indictment papers.

Man accused of having sex with boy he met online

Nassau, BAHAMAS- A cook is facing charges after police allegedly caught him having sex with a 15-year-old boy he met online.

Mario McPhee,24, was allegedly caught in the act when officers patrolling the Palmdale area around 2am on Friday, August 4 went to investigate a car parked in front of a business.

McPhee is charged with possession of child pornography after officers allegedly found sexually explicit images of the minor in his phone.

McPhee didn’t have to plead to charges of unlawful sexual intercourse with a minor of the same sex and child pornography when he made his first court appearance before Acting Chief Magistrate Roberto Reckley.

The age of consent for the same sex relationships is 18.

Bail was denied. However, McPhee can seek bail before a Supreme Court judge.

He’s next expected in court on October 26.
