Pregnant woman’s killer spared death penalty

NASSAU-A man who raped and murdered a pregnant woman inside her home shortly after he’d been freed from prison has been spared the death penalty.

Alister Williams, 34, Garden Hills, strangled 35-year-old Guyanese teacher Marisha Bowen with a belt and stabbed her in the neck six times, killing her and her unborn child in September 2016.

But Justice Carolita Bethell declined to impose the death penalty, saying the gruesome crime did not meet the “worst of the worst” standard set by the Privy Council, the country’s highest court.

The judge, however, imposed a stiff sentence of 55 years in prison, as she believed Williams would reoffend.

Gruesome

Bowen’s neighbours called police to her apartment on Red Sea Road after they found her murdered in her bedroom around 8am on September 9.

They made the gruesome discovery after they went to investigate her screams, the court heard.

Bowen, who taught at the Charles Saunders High School, was found naked on her blood soaked bed.

Williams was linked to the brutal crime after his DNA was found in blood in the apartment, under Bowen’s fingernails and his semen was found in her vagina.

What’s more, police found Williams with two cellphones when they arrested him.

One of the phones belonged to Bowen; the other was her son’s.

No remorse

Williams denied the involvement in the murder and robbery at his trial. He claimed that someone else killed Bowen and gave him her belongings.

A jury took less than two hours to unanimously convict Williams of the crimes on May 24, 2018.

The penalty phase of his trial was delayed because he fired Public Defender Stanley Rolle in October 2018. This meant court-appointed lawyer Christina Galanos needed time to familiarize herself with the case.

Additionally, there were delays in the preparation of the psychiatric and probation reports.

Psychiatrist Dr John Dillet believed that Williams could be reformed. However, probation officer Matrena Carey disagreed.

The probation report gave a chilling account of Williams’ criminal history that began when he was a teen.

The report said that the mother of Williams’ only child described him as “extremely physically abusive.”

The woman also accused him trying to rape her friend.

According to the report, “It was general consensus in the neighbourhood that he is a criminal and sexual predator.”

Prosecutor Rodger Thompson cited Williams’ criminal history and lack of remorse to make a case for the death penalty.

On the other hand, Ms Galanos suggested that a prison sentence in the range of 30 to 60 years was appropriate.

Senior Justice Bernard Turner delivered the sentencing decision for Justice Bethell, who is now an appellate court judge.

The 55-year sentence takes effect from the date of conviction.

Man accused of indecent assault of 5-year-old boy

NASSAU- A man accused of the indecent assault of a 5-year-old boy has been remanded to the Bahamas Department of Corrections.

Jose Thompson, 41, of Caribbean Road, off Gladstone Road, allegedly committed the crime between November 1 and 30.

Since Thompson will be tried in the Supreme Court, he was not required to enter a plea to the charge when he appeared before Magistrate Armbrister on Thursday.

Prosecutors plan to fast-track Thompson’s trial to the Supreme Court with a voluntary bill of indictment on February 9, 2021.

Ex- John Watlings accountant accused of $200k theft

NASSAU- A former accountant at John Watlings Distillery is fighting for her freedom and professional reputation after being accused of stealing close to $200,000 from the company.

Prosecutors say Tabitha Wells, between February 11, 2020 and August 19, 2020, stole $198,113.35 by falsifying entries in the company’s accounting programme.

Wells, 39, of Blair Estates, allegedly pocketed money that she didn’t enter as the distillery’s cash receipts

Wells, who is represented by Ian Cargill, denied charges of stealing by reason of employment, falsification of accounts and acquisition of the proceeds of criminal conduct at an arraignment before Magistrate Ambrose Armbrister.

She’s been released on $9,900 bail and is scheduled to return to court on April 13, 2021.

Long Island double murder heads to Supreme Court

NASSAU- A double murder case that rocked Long Island is headed to the Supreme Court.

Prosecutors say Nathan Harding, of Salt Pond, Long Island, murdered his grand aunt Jane Harding, 62, and her daughter Melissa Hui, 34 after raping them.

They were reported missing on February 25 after Hui failed to report to work.

Their disappearance became a murder investigation after search teams found them buried under rocks on a beach in Salt Pond on February 28.

Prosecutors served Harding, 19, with the evidence that they intend to rely on at his trial.

Harding, who is still in custody, will be arraigned on the rape and murder charges before Senior Justice Bernard Turner on January 15, 2021.

Man threatened to kill mother of his child

NASSAU- A 30-year-old man, who made death threats to the mother of his son after leaving Child Support Court, has been given a conditional discharge.

Keith Forbes, of Beldock Avenue, pleaded guilty to threatening to kill Janice Bullard outside of the Magistrates’ Court Complex during an argument on December 14.

In mitigation, defense  lawyer Ian Cargill said that Forbes made the threat an anger when he saw his child in a car.

Magistrate Ambrose Armbrister didn’t convict Forbes, although he found the charge of threats of death proved.

Instead, he ordered to complete 40 hours of community service. However, Forbes will spend two weeks in prison if he breaches the court’s order.

Nygard faces extradition on sex trafficking claims

Canadian fashion mogul Peter Nygard is facing extradition to the United States.

Nygard, 79, was arrested in Winnipeg Monday night following the unsealing of an indictment in Manhattan Federal Court charging him with sex trafficking and racketeering.

The indictment alleges that since 1996 he used the Nygard Group “as well as its employees, funds, and other resources, to recruit and maintain adult and minor-aged female victims for NYGARD’s sexual gratification and the sexual gratification of his friends and business associates.”

Banker accused of loan fraud freed on bail

NASSAU- A former banker accused of participating in a loan scheme that defrauded the Royal Bank of Canada out hundreds of thousands of dollars has been freed on bail.

Erma Mitchell, 67, was freed on $9,900 bail shortly after she faced 88 counts accusing her of defrauding the bank out of $368,900 from April 2008 to December 2009.

Prosecutors allege that Mitchell, who worked as a personal finance services officer at the bank’s JFK branch, carried out the scheme by doctoring loan applications and submitting forged supporting documents.

She denied charges of falsification of accounts, forgery, uttering forged documents and fraud by false pretenses at her arraignment before Magistrate Ambrose Armbrister on Monday.

Mitchell’s trial is set for May 25. She is represented by Jairam Mangra.

Drug boat captain loses bid to cut sentence

NASSAU- A boat captain sentenced to five years in prison has lost a bid to cut his sentence.

Acting on a tip, officers from the Drug Enforcement Unit boarded the wooden sloop captained by Clodius Michel at the dock in Inagua on June 23, 2018.

During a search, they found 40 pounds of cocaine, worth $330,000, inside a secret compartment in the living quarters.

Michel, 33, of La Tortue, Haiti, admitted to smuggling the drugs from Haiti. He told police he was supposed to deliver the drugs to an unidentified man.

Michel filed an appeal against his sentence arguing that it was too harsh as he pleaded guilty at the first opportunity.

However, the Court of Appeal upheld the sentence after ruling it was not unduly severe.

Trafficker pays sex slave $10k in restitution

NASSAU-A Dominican woman who forced a woman to work as a sex slave has paid her victim $B10,000 in restitution as part of her sentence.

Sobeyda Reyes-Garcia, 39, was sentenced to two years in prison and ordered to pay restitution after her human trafficking case ended with a plea deal on Friday.

The two-year sentence amounts to time-served. That’s because Reyes-Garcia received credit for the 16 months spent on remand and a one-third reduction for good behaviour.

Garcia-Reyes’ 23-year-old victim came to The Bahamas in December 2018 after she responded to an ad for a babysitter. Instead, she found herself held against her will and forced to sell her body. But the woman woman fled her captors on January 31, 2019 and reported the matter to police.

After a police investigation, Reyes-Garcia was charged with conspiracy to engage in trafficking in persons, engaging in trafficking in persons and unlawfully withholding identification.

Prosecutors dropped the charge of withholding the trafficked woman’s passport as part of the plea agreement.

Garcia-Reyes pleaded guilty to the remaining charges when she appeared before Chief Magistrate Joyann Ferguson-Pratt.

Abandoned baby found

NASSAU – A newborn baby was found abandoned at a construction site Saturday morning.

The baby boy was found at the Church of the Nazarene off East Street after 11am.

Workers at the site found the infant wrapped in a blanket and its umbilical cord was still attached.

It’s unclear how long the baby was at the site before he was found.

The baby is receiving medical attention at hospital.
