Sick grandma freed from jail after sentence cut

Nassau, BAHAMAS- A sick grandmother who tried to hide her grandson’s gun during a police raid has been released from prison after the Court of Appeal reduced her sentence.

Freda Hart, 81, was originally sentenced to 12 months in prison for possession of an unlicensed firearm and ammunition. Her grandson, James Hart, was jailed for 30 months for the same crime.

In a majority decision, the Court of Appeal ruled that Ms Hart’s sentence would be reduced to six months and 12 days—the time she had already spent in custody.

In delivering the decision of the Court, Sir Michael Barnett said that the panel was entitled to consider Hart’s medical condition.

She has high blood pressure, high cholesterol, an enlarged heart and early signs of dementia.

This information was not before the magistrate when he passed sentence.

If the magistrate had this information, Sir Michael said he might have imposed a different sentence on Hart, who had no previous convictions.

Sir Michael said the time Hart had spent in custody was sufficient punishment for her “serious mistake.”

He said, “She should spend no further time in prison, and she should be released immediately to spend time with her children and grandchildren.”

In a dissenting judgment, Justice of Appeal Jon Isaacs said the decision to release Hart could encourage criminals to use their older relatives as a shield since the court would give them a “pat on the hand.”

Justice Isaacs said, “It is significant that she knew where to find the weapon, as that suggests previous knowledge of its presence in the closet. Further, instead of immediately owning up to her transgression, she entered a not guilty plea and had the prosecution run an entire case.”

After her conviction, Hart claimed that she intended to give the gun to police.

According to the evidence, Hart put up a struggle when an officer tried to take the towel from her.

A loaded 9mm pistol, which was in the ready-to-fire position, fell to the ground.

Justice Isaacs said there was no evidence that the prison could not treat any of Hart’s ailments.

Consequently, he said the Court lacked jurisdiction to amend her sentence.

Man accused of sex with boy granted bail

Nassau, BAHAMAS – A man has been granted $9,500 bail after being accused of having sex with a teen boy and possessing pornographic images of him.

Police arrested Mario McPhee Jr, 24, on August 4 after they allegedly caught him having sex with a 14-year-old boy in his car that was parked in front of a funeral home in Palmdale.

While under arrest, police allegedly recovered pornographic images of the child in his phone.

As a condition of bail, McPhee has to sign in at the Fox Hill Police Station and have no contact with his alleged victim.

Man charged with rape ‘promised’ accuser cash

Nassau, BAHAMAS- A man accused of rape told a policeman that he had broken a promise to give his alleged victim money.

Inspector Timothy Bain testified in the Supreme Court that Kevin Cooper denied the rape allegation when he arrested him on November 18, 2022.

Bain told the judge and jury, “He said that he didn’t know what I was talking about. He said that they would occasionally meet and have interactions. He said he made a financial promise to her that he did not fulfill.”

Cooper’s lawyer, Miranda Adderley, asked the officer, “He didn’t tell you that he promised to pay her for sex?”

Bain said he didn’t recall that; however, he said that Cooper claimed that he had consensual sex with his accuser.

At the time of his arrest at the Rubis Service Station on West Bay Street, Cooper was wrapped in a floral bed sheet.

His accuser was also at the service station. She was crying uncontrollably and appeared distraught, according to Bain.

Divorcing man accused of attack on wife and child

Nassau, BAHAMAS- A man, who has filed for divorce, has been charged after allegedly attacking his 32-year-old wife and their two-year-old daughter.

Police arrested the man on August 9 after his wife alleged that he pulled a handgun on her, threatened to kill her and beat up their child.

Police did not recover a firearm. They charged the husband with assault with a deadly weapon, threats of death and cruelty to children.

He pleaded not guilty at his arraignment and was granted $7,000 bail.

As a bail condition, the man has to leave the marital home and stay at least 300-feet away from his wife.

He will be allowed supervised visits with his daughter with the permission of Social Services.

The man’s trial is set for October 23.

Parents held in death of son, 2,

Nassau, BAHAMAS- Police have arrested the parents of a two-year-old boy in relation to his death on August 12.

The suspects were driving on Robinson and Old Trail Roads when other motorists alerted them their son appeared unconscious and his head was hanging out of the car window.

The boy was removed from the window and taken to the hospital, where he died.

As a result, his parents were arrested on suspicion of manslaughter by negligence.

Cops seek neighbour for sex assault on girl, 8

Nassau, BAHAMAS- Police are looking for a man accused of sexually assaulting his neighbour’s eight-year-old daughter.

The incident allegedly took place in New Providence on Monday, August 14.

The child’s father reported the alleged incident to the South Central Police Station, prompting an investigation.

Wanted suspect charged with murder

Nassau, BAHAMAS- A wanted suspect is behind bars after being charged in relation to a fatal shooting earlier this month.

Prosecutors say Lavardo Poitier is responsible for the August 4 murder of Omar Fox.

The incident happened outside a bar on Rosedale Street around 11pm.

Police said a man on the back of a truck shot Fox as he argued with two other men on the street.

Poitier didn’t have to plead to the murder charge when he appeared before Acting Chief Magistrate Roberto Reckley on Monday.

He is next due to appear in court on November 14 to receive a voluntary bill of indictment.

Man accused of sex with underage girl

Nassau, BAHAMAS – A 32-year-old is facing charges allegations of unlawful sexual intercourse with a child he knows.

Prosecutors say Angelo McQueen, of Ridgeland Park, had illegal relations with a 14-year-old girl in December and January of 2022.

The age of consent in heterosexual relationships is 16.

McQueen didn’t have to enter pleas to the charges when he appeared before Senior Magistrate Carolyn Vogt-Evans.

He was denied bail and returns to court on November 8.

Gas delivery man robbed at gunpoint

Nassau, BAHAMAS- A man was robbed of cash while making a gas delivery on Sunday, police said.

The victim was delivering gas to a home on Palm Beach Street when he was confronted by a lone gunman who demanded cash.

The robber, who hid his face with a blue towel, was given an unknown sum of money before he fled in a red car.

4 months in jail after car stolen from police station

Nassau, BAHAMAS- A man has been jailed for four months after a car was stolen from a police station.

Gerald Mackey pleaded guilty to receiving a white Nissan Cube that was being kept at the Criminal Investigations Department (CID) on University Boulevard.

The vehicle had been reported stolen by its owner.

When police recovered the car, they didn’t return it to her immediately because it appeared that the chassis numbers had been altered.

While the car was impounded, it was stolen from CID’s parking lot.

With the help of surveillance footage, police arrested Phillano Williams, who’s on bail for murder, and Mackey.

Mackey told police that he had been asked to drive the car home.

He said that he was told to wait at the gas station next door while the car was retrieved.

Mackey was also ordered to pay $480 in restitution to the vehicle’s owner in order to avoid serving a consecutive sentence of three months on a charge of causing damage.

Meanwhile, Mackey’s co-accused Williams pleaded not guilty to stealing, receiving, causing damage and trespassing.

He was granted bail and is scheduled to return to court on October 16 for his trial.
