NASSAU-A former fugitive who jumped his bail and was later arrested in the United States will remain in custody, Court of Appeal judges ruled.
U.S. authorities arrested Jiles Jackson Russell for human smuggling on March 17, 2018, four days before his scheduled trial.
At the time of his arrest, he was wearing an ankle bracelet for charges stemming from an armed robbery on April 16, 2014.
Prosecutors say Russell, 37, robbed a man and attempted to rob another man at gunpoint.
One of the victims was a policeman, who drew his gun, and a shootout ensued.
Police arrested Russell a short time later when he showed up at the hospital with gunshot wounds. They allegedly found him with the stolen money.
Russell was sentenced to 33 months after he pleaded guilty to encouraging and inducing aliens to land in the United States.
He was deported to The Bahamas after serving his time and his bail was revoked on March 30, 2021.
A back up trial date of July 26 and a substantive trial date of August 2 were set.
After his trial did not proceed, Russell applied for bail.
In November 2021, Justice Guillimina Archer-Minns denied Russell bail on the basis that he was a flight risk.
Russell tried to have the decision overturned on appeal.
The Court ruled said the judge could not be faulted for concluding there were no conditions she could impose to ensure that Russell showed up for his trial.
Russell’s trial is set for August 2022.
